Abstract

Although very few people appear to travel to the Nordic region in contexts that might accurately be described as ‘climate-related,' some Nordic states have developed bespoke legal provisions, and all have ‘exceptional grounds’ categories that may be applied when people seek to enter or remain in the context of climate change or disaster. This chapter provides a brief overview of legal provisions relevant to cross-border climate and disaster-related displacement across the region, before examining the operation of migration provisions in relevant Swedish cases decided between 2006 and 2019. The chapter acknowledges that Nordic states no longer appear to embrace the norm entrepreneurship that characterised their contribution to refugee and human rights law in previous decades and contends that some room exists for pragmatic alignment of executive and judicial decision-making with the Agenda for the Protection of Cross-Border Displaced Persons in the Context of Disasters and Climate Change. It calls for further research on how decision-makers in Nordic states respond to applications to enter or remain on their territory in contexts related to disasters and climate change.
