Abstract
This thesis examines the legal history of the Swedish state monopoly on alcohol retail, focusing on how restrictions on freedom of trade and purchasing rights have been regulated and justified, primarily from the 1850s to the present day. The thesis analyzes the underlying political reasoning and how this has shifted in line with changes in society, from early moral education to modern public health policy.

The essay shows that the Swedish retail monopoly is based, among other things, on the principle of disinterest, which aims to remove individual profit interests from the alcohol trade in order to minimize social harm. This thesis examines the legal history of the Swedish state monopoly on alcohol retail, focusing on how restrictions on freedom of trade and purchasing rights have been regulated and justified, primarily from the 1850s to the present day. The thesis analyzes the underlying political reasoning and how this has shifted in line with changes in society, from early moral education to modern public health policy.

The essay shows that the Swedish retail monopoly is based, among other things, on the principle of disinterest, which aims to remove individual profit interests from the alcohol trade in order to minimize social harm. It highlights how developments have progressed from the 18th century's financially motivated Kronobrännerier (crown distilleries), which encouraged legal consumption to counteract home distilling and increase revenue to the state treasury. To the 1855 regulations that introduced municipal vetoes and the foundations for social responsibility that are still reflected in Swedish legislation today.

Central to the Swedish state's relationship with alcohol, and something that must be addressed in order to understand the retail monopoly on alcohol that we have today, is the so-called Brattsystemet. This system, with strict rationing and bookkeeping, completely dominated Swedish alcohol policy until its abolition in 1955. When it was abolished, a paradigm shift took place, with positive measures and general legislation replacing individual control. The effects of Sweden's entry into the EU are also analyzed, as import, export, and wholesale monopolies were abolished while the retail monopoly (Systembolaget) was retained on the grounds of protecting people's health and lives.

The discussion also touches on modern legal developments, including the introduction of on-farm sales of alcohol (gårdsförsäljning, a form of producer-to-consumer sales), and how this reflects the modern legislator's handling of and view of the monopoly.

The overall conclusion is that the motives for the alcohol monopoly have shifted from state profit and moral control of primarily the working class to today's modern strategy, where the state uses the monopoly to try to lim-it the social and individual costs of alcohol. Paternalistic traces are still present but significantly less intrusive than under the Brattsystem. One can speculate whether a continued shift towards reduced state control will lead to the demise of the monopoly, or whether current arguments will continue to be sufficient to defend Sweden's historically long-lived "system" that continues to have strong popular support. Denna examensuppsats undersöker den rättshistoriska utvecklingen av det svenska statliga detaljhandelsmonopolet för alkohol med fokus på hur inskränkningar i näringsfriheten och köprätten reglerats och motiverats från framförallt 1850-talet fram till idag. Uppsatsen analyserar de bakomliggande politiska resonemangen och hur dessa har skiftat i takt med samhällets förändringar, från tidig moralisk fostran till modern folkhälsopolitik.

Denna examensuppsats undersöker den rättshistoriska utvecklingen av det svenska statliga detaljhandelsmonopolet för alkohol med fokus på hur inskränkningar i näringsfriheten och köprätten reglerats och motiverats från framförallt 1850-talet fram till idag. Uppsatsen analyserar de bakomliggande politiska resonemangen och hur dessa har skiftat i takt med samhällets förändringar, från tidig moralisk fostran till modern folkhälsopolitik.

Uppsatsen visar att det svenska detaljhandelsmonopolet bland annat vilar på principen kring desintressering, vilken syftar till att avlägsna det en-skilda vinstintresset från alkoholhandeln för att minimera sociala skade-verkningar. Den belyser hur utvecklingen rört sig från 1700-talets finans-politiskt motiverade Kronobrännerier, som uppmuntrade laglig konsumtion för att motverka hembränning och öka inkomsten till statskassa. Till 1855 års förordningar som införde kommunalt veto och grunderna för det sociala ansvarstagande som än idag återspeglas i den svenska lagstiftningen.

Centralt för den moderna svenska statens relation till alkohol och något som måste behandlas för att förstå det detaljhandelsmonopol för alkohol vi har idag är det så kallade Brattsystemet. Detta system, med ransonering och motbok, kom helt att dominera den svenska alkoholpolitiken från bör-jan av förra seklet fram till dess avveckling år 1955. Därefter skedde ett paradigmskifte med införande av positiva åtgärder och generell lagstift-ning istället för individuell kontroll. Vidare analyseras i arbetet effekterna av Sveriges inträde i EU, då import-, export- och partihandelsmonopolen avskaffades medan detaljhandelsmonopolet (Systembolaget) bibehölls med hänvisning till skyddet av människors hälsa och liv.

Diskussionen berör också den moderna rättsutvecklingen, däribland infö-randet av gårdsförsäljning, och hur denna speglar den moderna lagstifta-rens hantering av och syn på monopolet.

Den övergripande slutsatsen är att motiven för alkoholmonopolet förskju-tits från statlig vinst och moralisk kontroll av framför allt arbetarklassen till dagens moderna strategi där staten använder monopolet för att försöka begränsa alkoholens samhälleliga och individuella kostnader. Paternalist-iska spår är fortfarande tydliga men betydligt mindre ingripande än under Brattsystemet. Man kan spekulera i huruvida en fortsatt förskjutning mot minskad statlig kontroll kommer att leda till monopolets undergång, eller om nuvarande argument kommer fortsatt vara tillräckliga för att försvara Sveriges historiskt långlivade ”system” som fortsatt har starkt folkligt stöd.
