- Domestic violence is a widespread social problem often characterized by repeated abuse, control, and psychological degradation over an extended period of time. Individuals subjected to such violence frequently live under a constant threat, which may affect both their ability to act and their perception of danger. At the same time, Swedish self-defense is largely based on the notion of a distinct and immediate attack, where the person acting in self-defense is expected to respond in direct connection to the threat. This raises the question of how well the traditional self-defense regulation is adapted to situations characterized by long-term intimate partner violence.

At the same time, Swedish self-defense is largely based on the notion of a distinct and immediate attack, where the person acting in self-defense is expected to respond in direct connection to the threat. This raises the question of how well the traditional self-defense regulation is adapted to situations characterized by long-term intimate partner violence.
This essay therefore examines the application of self-defense law in situations involving domestic violence, with particular focus on how the requirement of an initiated or imminent attack under Chapter 24, Paragraph 1 of the Swedish Penal Code is interpreted and applied. Special attention is given to how courts assess the threat posed by repeated and long-term violence, as well as the extent to which the victim’s circumstances and scope for action are considered in the self-defense assessment. The essay also includes a comparison between Swedish and Norwegian law in order to examine whether the Norwegian regulation offers more appropriate protection for woman in such situations.
The essay thereby highlights the difficulties that may arise when the traditional requirements of self-defense encounter the reality of domestic violence, where the threat is often recurring and constantly present than immediately forthcoming in a single situation. (Less) - Abstract (Swedish)
- Våld i nära relationer är ett omfattande samhällsproblem som ofta kännetecknas av upprepat våld, kontroll och psykisk nedbrytning över lång tid. Den som utsätts för sådant våld lever många gånger under en ständig hotbild, vilket kan påverka både personens handlingsutrymme och dennes uppfattning av fara. Samtidigt bygger den svenska nödvärnsrätten i stor utsträckning på föreställningen om ett avgränsat och omedelbart angrepp, där den angripne förväntas agera i direkt anslutning till hotet. Detta aktualiserar frågan om hur väl den traditionella nödvärnsregleringen är anpassad till situationer som präglas av långvarigt partnervåld.

Särskild uppmärksamhet riktas mot hur domstolarna bedömer den hotbild som kan uppstå genom upprepat och långvarigt våld, samt i vilken utsträckning den utsattes situation och handlingsutrymme beaktas vid nödvärnsbedömningen. Uppsatsen innehåller även en jämförelse mellan svensk och norsk rätt i syfte att undersöka om den norska regleringen erbjuder ett mer ändamålsenligt skydd för våldsutsatta kvinnor.
Uppsatsen belyser därmed den problematik som kan uppstå när nödvärnsrättens traditionella krav möter den verklighet som präglar våld i nära relationer, där hotet många gånger är återkommande och ständigt närvarande snarare än direkt förestående i en enskild situation. (Less)
